<p>Most major cities in the United States enforce a required number of inspections at different stages of the process. Many builders of residential real estate will cite these inspections as being the reason why inspections aren&#8217;t necessary.</p>
<p>Time and time again, regardless of the number of city inspections, real estate consumers purchasing new construction commonly find problems after moving into their homes within 5 years. Many times, these problems can be attributed to a defect during the build process of their home. Unfortunately, consumers are forced to rely on the warranties provided by their builder. This home warranty process has been known to be time consuming and stressful.</p>
<p><span id="more-375"></span>What can you do when buying a new construction home? Get your own inspection. Inspections can be performed in two key areas during the construction of your home; pre-drywall and final walkthrough.</p>
<p>Pre-Drywall Inspection</p>
<p>Before the drywall has been installed in your home, ask your sales counselor or real estate agent about performing an inspection. At this stage of your construction, main load bearing studs, wiring, and plumbing can be easily seen by an inspector. Builder sales counselors will usually recommend that you perform your inspection prior to your pre-drywall walkthrough so that all items found on your inspection report can be addressed with your builder&#8217;s superintendent (the person managing the build out of your home).</p>

<p>If you performed a pre-drywall inspection, this follow up visit by your inspector will simply be an assurance that all items requiring repair were repaired or replaced. 			<content:encoded><![CDATA[<p>Homebuyers are out looking again; despite the news reports we have been hearing&#8230;there are buyers! I have received many calls from clients who are contemplating new construction or a resale home. In my St George Utah real estate market, buyers have an advantage with plenty to choose from, no matter what you want to buy. Builders have record number of homes available and the St George MLS reflects an unusually high number of listings. The high inventory coupled with lowering interest rates is making for a great buyer opportunity.</p>
<p>New construction is always appealing. To own a home that no one else has lived in, a blank canvas to create a home that can be yours (and the fact that everything is new) is desirable to most buyers. However, something to consider is that blank canvas can ultimately become an expensive masterpiece. With new construction, you must consider the costs of landscape (sod, trees etc&#8230;), window coverings, patios or patio covers, concrete work, and possibly block walls or fences. This is not to say that you should avoid new construction, it is only expenses that are occasionally overlooked. Selecting a home with a reputable builder who is familiar with environmental issues within the region is imperative. <span id="more-372"></span>With all of the lending issues currently present, homeowners that are having problems also includes home BUILDERS facing financial concerns. A homebuilder could possibly bypass construction requirements in an attempt to make the home appear complete in order to place it for sale. Possibly they are risking foreclosure on the home and rushing to get the home sold could potentially provide profit. A home inspector is a necessity even for new construction. A home warranty from a reputable company is recommended. A home warranty can cover the homeowner for future problems, such as electrical, plumbing, appliances, and even the garage door opener. The home warranty company will repair or replace covered appliances or home issues, for a small deductible. This will give the homeowner peace of mind for home repairs. This will be comparable to a new construction home warranty; however, keep in mind that if the builder disappears, it may become impossible to have your warranty honored.</p>
<p>Always research any home, new or pre-owned. Never make a purchase without utilizing the services of a qualified home inspector. A job, any job, whether it is in the conventional job market or any one of a number of work from home ventures all require the same thing &#8211; people of vision.</p>
<p>Vision sees the entire portrait, balanced, controlled, and proportionate while focus concentrates solely on one aspect of the portrait. Don’t misunderstand, having focus is not a bad thing as long as it doesn’t loose sight of vision.</p>
<p>In building your road to success you must take several things into account if you want your road to remain stable and strong. These are;</p>
<p>Objectives:</p>
<p>Ask yourself the following questions. Why do you want to go into business? Where do you want to be in 3 months, 6 months and 1 year? What will it take to get you there? Do you believe in what you’re selling? Think about these and write down your answers. They will be the foundation upon which the rest of your business goals will be built.</p>
<p><span id="more-349"></span>Knowledge Base:</p>
<p>What we want to know here is how well you know your subject. Are you familiar with the products or services you will be representing? Do you have immediate access to training materials and technical support if you need it? Do you know where to get the materials and training? Have you researched your subject? As you are going to build these roads to success for yourself approach this part of your learning curve with a child like appetite for knowledge. You can never have enough tools! Just make sure they’re the one’s you need for the task at hand.</p>
<p>Using Your Resources:</p>
<p>A good manager regardless of industry knows his people. He knows their strengths and their weaknesses and will use these resources appropriately in helping his team achieve a particular goal. Take a moment to stand back, listen, observe. By doing so, you are literally guaranteeing your success.</p>

<p>A final thought on keeping your “Road” on solid ground. You’ve got your objectives identified, your resources have come together nicely and everything is starting to gel – at the end of your day you need to ask; would I hire myself? If you have trouble answering that, start over again with the basics and re-examine your motivations and your goals. Be honest with yourself then move on. The road will have bumps. That’s to be expected. Don’t let these bog you down – use them to your advantage! If you think about it, that’s the beauty of a mistake, it can be your best friend or worst enemy depending upon how you approach it.</p>
<p>Business Ethics:</p>
<p>I couldn’t let this article go without mentioning business ethics – a trait that seems to be sorely misunderstood, often abused, and seldom used. If you don’t possess a strong business ethic, in the end you will be found out and your credibility will be forever damaged. Too many times ethics are driven by politics within an office atmosphere to the point where the mission statement is just that – a statement and nothing more.</p>
<p>To many times I have sat in on meetings that either discussed rules, company ethics or customer service. I have also attended several seminars in which these themes were quite prevalent. What always amazed me however is that the “new” and “improved” ways of attracting customers or quality associates to your business were the same things that were in practice over 30 years ago! Someone tried to re-invent the wheel, re-packaged it in something shiny and is selling it to you as the cure for all your business woes.</p>
<p>Above all else, always remember that regardless of your business or station in life, you are a consumer and as such you should have a pretty good idea of your likes and dislikes.</p>
<p>While the statement “honesty is the best policy” is nothing new, my grandfather telling me it was always easier to tell the truth because a lie would always have to be remembered so it could be told over and over again, is new – not to me, but to others.</p>
<p>Something will have to drive you to the front away from the pack! What will it be? Each of use must choose those attributes and find the combination that will work but we must never loose sight of our goals or “sell” our souls to achieve them.</p>
<p>Regardless of what you may think, you can not teach someone Honor, Integrity, Loyalty or Truthfulness. They either have it or they don’t. Remember, while you can lead a horse to water, you can’t make him drink however, you can make him thirsty!</p>

In essence, the Act purports to prevent the misclassification of employees as independent contractors while conducting construction related activities. The new law is aimed at stopping contractors avoid paying overtime benefits, payroll taxes, workman&#8217;s compensation, etc.</p>
<p>In reality, the Act is another overreaching piece of legislation intended on benefiting a few while harming a great many small business owners. The new law requires that no unincorporated or unorganized sole proprietor or partnership be classified as an independent contractor unless they satisfy all twelve elements enumerated in the Act. This applies to construction, trucking, landscaping and related trades, as defined under the Act. The law basically provides more narrow but explicit definitions of an independent contractor. The places the risk squarely on the contractor should the potential that any of its independent contractors are actually classified as employees under the new law.</p>
<p><span id="more-343"></span>Of course, this is burdensome and unfair to the contractor as they may now be faced with having to require that each of their unorganized subcontractors incorporate or otherwise organize to avoid potential risk. The biggest issue is the filing of income taxes. The sole proprietor must file his or her income taxes relating to the independent business to avoid being classified as an employee under the Act. Seemingly, contractors conducting construction and the other related activities are now directly at risk for any such failure to file.</p>
<p>In case you haven&#8217;t guessed already, the new law certainly benefits the unions. Under the Act, labor unions or any other interested parties, including competitors, former employees or anyone else can report a construction or construction-related company using &#8220;employees&#8221; as independent contractors. Of course, the AFL-CIO and Teamsters strongly supported the passage of this ridiculous law.</p>
<p>The effects of this new law will likely be staggering. Besides the obvious disadvantages to contractors, the Unions now will enjoy even greater power to force unionization, further crippling small business in this State.</p>
<p>Keep in mind, the law is new and no interpretative regulations or decisions yet exist. And many have argued against the constitutionality of such a wide-seeping and overreaching piece of legislation. However, until the law is repealed or amended, contractors must play it safe.</p>
<p>Obviously, requiring that each independent subcontractor incorporate or otherwise organize is just impractical. Fortunately, requiring incorporation is not required, only the most conservative approach. Contractors can and should utilize an independent contractor agreement drafted specifically to comply with the provisions of the new law. And contractors already using such agreements should have their attorneys audit them to ensure compliance with the Act.</p>
<p>Contractors need to maintain avoidance of the qualifications typically defining an employee under federal and/or state law. This includes control over the subcontractor, including hours, equipment, methods of work, etc., among other items. Thus, an independent contract agreement should specifically address the qualifications used to determine the definition of an employee under Federal and state law. Utilization of such an agreement should ensure contractor compliance with the Act.</p>

<p>Most major cities in the United States enforce a required number of inspections at different stages of the process. Many builders of residential real estate will cite these inspections as being the reason why inspections aren&#8217;t necessary.</p>
<p>Time and time again, regardless of the number of city inspections, real estate consumers purchasing new construction commonly find problems after moving into their homes within 5 years. Many times, these problems can be attributed to a defect during the build process of their home. Unfortunately, consumers are forced to rely on the warranties provided by their builder. This home warranty process has been known to be time consuming and stressful.</p>
<p><span id="more-340"></span>What can you do when buying a new construction home? Get your own inspection. Inspections can be performed in two key areas during the construction of your home; pre-drywall and final walkthrough.</p>
<p>Pre-Drywall Inspection</p>
<p>Before the drywall has been installed in your home, ask your sales counselor or real estate agent about performing an inspection. At this stage of your construction, main load bearing studs, wiring, and plumbing can be easily seen by an inspector. Builder sales counselors will usually recommend that you perform your inspection prior to your pre-drywall walkthrough so that all items found on your inspection report can be addressed with your builder&#8217;s superintendent (the person managing the build out of your home).</p>
<p>Pre-Walkthrough Inspection</p>
<p>If you performed a pre-drywall inspection, this follow up visit by your inspector will simply be an assurance that all items requiring repair were repaired or replaced. This inspection will also verify that appliances, fixtures, and building code violations are reported and given to you to provide to your builder.</p>
<p>Many new construction builders of residential properties will not bring up your options to an outside inspection for your new home. Performing one, however, is highly recommend and can offer a significant piece of mind to you and your family well into the future.</p>

During the past, windmills were usually given the name similar to that of the place in which they were erected. Or in some instances, the name of the person who made or operated the mill, in which case, he is called the miller, were used to refer to the mill itself. Even if careful planning was made in connection to the building of the mill, no one could know for sure if these mills would actually work once in place. In other words, in windmill construction, there is always the element of suspense. For instance, even if a person prepared a good plan in the construction of the windmill, it might not work if he made two windmills and the distance between such windmills is too close to as to cause wind turbulence which will in turn make each of the said windmill ineffective.</p>
<p><span id="more-337"></span>In windmill construction, one has to take into consideration the wind movements. In connection with this, are wind directions, changes in said wind directions, wind speeds and the change of these speeds, and a lot of other considerations? This is important in the construction of a windmill because if a windmill is constructed in an improper way, it might result into the destruction of said windmill. For example, if a windmill is not capable of being turned to the direction of the wind, it might result into the destruction of its shutters or it might get blown off.</p>
<p>Constructing your own windmill isn&#8217;t really that difficult. Various sources have provided for its proper construction.</p>
